Legal
Terms of Use
Effective date: October 24, 2026
General-purpose notice. These terms are written in plain language for a general business website and are not legal advice.
1. Agreement to these terms
These Terms of Use ("Terms") govern your use of sommertech.solutions (the "Site"), operated by SommerTech Solutions ("SommerTech," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Our Privacy Policy explains how we handle information.
2. Information only, not professional advice
The content on the Site is provided for general informational purposes about our services. It is not legal, compliance, insurance, or other professional advice, and it is not a guarantee of any security outcome. Cybersecurity is an evolving field and no service can eliminate all risk. References to frameworks and regulations such as HIPAA, PCI DSS, SOC 2, or CMMC describe the kinds of help we offer; they do not mean that using the Site or our services makes you compliant or certified. Formal audits and certifications are performed by independent assessors.
3. No client relationship until a signed agreement
Browsing the Site, sending a message through the contact form, or requesting a free assessment does not create a client relationship, a service commitment, or any duty of confidentiality on our part. Our services are provided only under a separate written agreement signed by you and SommerTech that describes the scope, fees, and terms of the engagement. Please do not send us passwords, security keys, or other sensitive or confidential information through the Site or by email before an agreement is in place. Any description of plans or pricing on the Site is general and is not an offer; final terms are set out in a signed agreement.
4. Acceptable use
You agree not to:
- use the Site for any unlawful, harmful, or fraudulent purpose;
- probe, scan, or test the vulnerability of the Site or its infrastructure, or bypass any security or access measure, without our prior written permission;
- attempt to gain unauthorized access to the Site, its servers, or other users' information;
- send malware, spam, or automated or excessive requests, or otherwise interfere with the Site's operation;
- use the contact form to submit false, misleading, or abusive content, or information about others without their permission; or
- copy, scrape, or reuse the Site's content or branding in a way that infringes our rights or misleads others.
If you believe you have found a security issue on the Site, we welcome a responsible, good-faith report through the contact form on our home page, mentioning "security report" in your message. Please do not access, change, or disclose data that is not yours, and give us reasonable time to respond.
5. Intellectual property
The Site, including its text, design, logo, illustrations, and code, is owned by SommerTech or its licensors and is protected by intellectual property laws. You may view and share links to the Site for personal or internal business purposes. Other use requires our written permission. Third-party names and trademarks belong to their respective owners.
6. Links and third-party services
The Site may link to or rely on third-party services (for example, our network provider, web host, and email providers). We do not control those services and are not responsible for their content or practices.
7. Disclaimer of warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
8. Limitation of liability
To the fullest extent permitted by law, SommerTech and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to your use of (or inability to use) the Site or reliance on its content. Our total liability for any claim relating to the Site will not exceed US $100. This section does not limit liability that cannot be limited by law. Liability for any paid services will be governed solely by the applicable signed services agreement.
9. Indemnity
You agree to indemnify and hold SommerTech harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site, to the extent permitted by law.
10. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Dallas County or Tarrant County, Texas, and you consent to their jurisdiction, unless a signed services agreement says otherwise.
11. Changes to the Site and these Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. The effective date at the top shows the latest version, and your continued use of the Site after a change means you accept the updated Terms.
12. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us about your use of the Site.
